Gag Order Request Against Trump Could Eventually Lead to Judge Cannon’s Removal, George Conway Says
George Conway said Special Counsel Jack Smith’s request for a gag order on Donald Trump may ultimately lead to the removal of the judge in the case if she declines to grant it.
The former president has been charged in federal court in Florida for what Smith says was Trump’s willful retention of government documents and his attempt to obstruct their retrieval. In August 2022, the FBI executed a search warrant at his Mar-a-Lago residence, where agents found a trove of material. Trump has pleaded not guilty.
In a fundraising email sent this week, Trump’s campaign claimed, “Biden’s DOJ was locked and loaded for deadly force at Mar-a-Lago.” The ex-president pointed to the term “lethal force” in the search warrant, which legal observers say is part of standard instructions to law enforcement in the rare instance they are met with deadly force. On Friday night, Smith’s team asked U.S. District Judge Aileen Cannon to impose a gag order on Trump to prevent him from attacking law enforcement agents involved in the case.
Appointed to the position by Trump in 2020, Cannon’s rulings in the proceedings have miffed legal experts who say her decision to indefinitely postpone a trial date shows she is thwarting prosecutors ahead of November’s election. If elected president, Trump could quash the documents case, as well as his federal trial in Washington, D.C., where Smith is prosecuting him for attempting to overturn his 2020 election loss.
“This really puts Judge Cannon on the spot,” Conway said on Friday’s installment of The Source on CNN. “This woman has absolutely, completely shown an absolute bias against the government from day one in multiple ways. She’s dragging her feet on this case and if she does not do something about this, I think special counsel may use this as the opportunity to try to get the Eleventh Circuit to get rid of her.”
Conway alleged that the false claim about an assassination attempt was “really an attempt to incite violence against government agents based on the complete, pathological lie and misreading and gross– just absolutely obscene misreading of a standard document that limits the use of force.”
He concluded by slamming the “moral depravity” of Trump and those in his circle.
Smith could ask the Eleventh Circuit Court of Appeals to remove Cannon from the case, which would be an extraordinary measure. Ty Cobb, who served as a lawyer in Trump’s White House predicted last month that the court of appeals will ultimately remove Cannon from the case over her “bias” toward Trump.
